In addition to the Terms of Use governing your use of the WAG RC website available at wagradiocontrol.ca (the “Website”), the Terms of Sale contained herein govern any order or purchase you make on our Website. WAG RC (“we” or “us”) is the operator of the website and the supplier of your order. By placing an order and accepting these Terms of Sale, you agree to be bound by these Terms of Sale whether or not you have read them. If you do not agree with these Terms of Sale, do not place your order.

Please print and keep a copy of these Terms of Sale for your records.

Purchasing Information

Purchases made on the Website are restricted to persons who have reached the age of majority in the jurisdiction in which they reside.

You must make a purchase on our website. You will then automatically receive an email confirmation of your order at the email address associated with your order. This email confirms receipt of your order by WAG RC but does not represent acceptance of your order. You will receive a delivery confirmation by email confirming the acceptance of your order and its delivery.

No changes can be made once your order has been submitted. WAG RC reserves the right, at its sole discretion, to cancel or refuse any order for any reason. Situations that may result in the cancellation or rejection of your order include (i) limitation of quantity available for purchase; (ii) inaccuracies or errors in pricing or item information on the website; or (iii) our inability to obtain a charge authorization confirmation on your credit card.

We may also require additional verification or information before accepting any order. WAG RC will contact you in the event that all or parts of your order are cancelled or to obtain additional information necessary to accept your order.

Prices and currency units

Prices displayed on the website are in Canadian dollars. Taxes and shipping and handling charges are listed during checkout, if applicable. You are responsible for payment of all shipping and handling charges and any federal and provincial taxes that may apply to your order. Taxes are applied in accordance with provincial and federal laws and the rate is based on the shipping address provided at checkout.

Terms of payment

You may pay for your order using American Express, MasterCard, Visa or Paypal. No cash, credit notes, checks, gift cards or international credit cards will be accepted. When paying by credit card, your name, address and postal code must match exactly the name, address and postal code on your credit card statement. You authorizeWAG RC to charge your payment method the amount of your order including applicable taxes, shipping and handling. You represent and warrant that you are the holder of the card or account in question. In the event that your payment method cannot be validated or processed, your order will not be delivered and WA GRC will have no obligation to process your order.

Shipping information

Purchases made on our website can only be shipped to Canadian addresses. Therefore, at the time of ordering, the shipping address must be complete and valid in Canada. You can track your order using the tracking number you have provided.

Returns and exchanges

You have certain statutory rights under provincial consumer protection law to cancel your order and WAG RC will comply with applicable laws. In addition to these statutory rights, WAG RC.

All purchases made on the website can only be returned for refund by mail. Merchandise must be intact and in its original packaging.

In order to make a return by mail, a Return Merchandise Authorization (RMA) number must be obtained within 15 days of the date of your purchase by either (i) visiting our website wagradiocontrol.ca and logging into your account; or (ii) contacting our Customer Service Department atinfo@wagrc.ca, and returning the merchandise to the sender’s address provided within 15 days of the date of purchase. Once the merchandise has been inspected, the refund will be issued according to the method of payment used, either by credit card or PayPal. The refund amount will reflect the purchase price and applicable taxes of the returned merchandise. Shipping charges included on the original invoice and any applicable taxes on the delivery will not be refunded. You are solely responsible for any shipping charges associated with the return of the merchandise. Unauthorized returns or returns that do not meet the above criteria will not be refunded and will be returned to the customer at the customer’s expense.

Waiver / limitation on warranty

SOME JURISDICTIONS, INCLUDING QUEBEC, DO NOT ALLOW THE EXPRESS OR IMPLIED EXCLUSION OR LIMITATION OF WARRANTIES, LIABILITY OR CERTAIN TYPES OF DAMAGES OR LIMITATION OF REPRESENTATIONS REGARDING PRODUCTS OR SERVICES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE EXCLUSIONS AND LIMITATIONS LISTED BELOW MAY NOT APPLY TO YOU.

WAG RC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, RELATED TO THE PRODUCTS SOLD ON THE WEBSITE, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

IN NO EVENT SHALL WAG RC OR ITS DIRECTORS, OFFICERS OR EMPLOYEES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR ANY OTHER DAMAGES WHATSOEVER ARISING OUT OF OR IN CONNECTION WITH THE USE OF ANY PRODUCT SOLD ON THE WEB SITE, EVEN IF WAG RC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Manufacturer’s warranties

WAG RC is a reseller of products manufactured by other companies. You may benefit from the warranty offered by the original manufacturer of the products you purchase from WAG RC, if such a warranty exists. Please contact the manufacturer of your product to claim this warranty.

Availability and descriptions

The purchase of a product on our website is subject to its availability. In the event that the requested product is not available at the time of your order, WAG RC will not be obligated to process your order and you will not be obligated to pay WAG RC for that order. Adding products to your shopping cart or to your “favorites” wish list is not a guarantee that these products will be available at the time your order is processed.

While we strive to update and ensure the accuracy of the products and prices contained on our website, it is possible that errors may be found and/or information omitted. In the event that an item is listed at an incorrect price or with incorrect information, WAG RC reserves the right, at its sole discretion, to refuse or cancel any orders placed for that item. You will be notified of any refusal or cancellation in the event that WAG RC decides to refuse or cancel your order due to incorrect pricing related to the item ordered.

PRODUCTS DISPLAYED ON THE WEBSITE MAY NOT BE AVAILABLE AT ALL TIMES AND PRODUCTS AND PRICES MAY BE SUBJECT TO CHANGE, SUBSTITUTION OR DISCONTINUANCE AT ANY TIME. WHILE WE ENDEAVOR TO PROVIDE YOU WITH AS ACCURATE A DESCRIPTION AS POSSIBLE OF THE ITEMS AVAILABLE ON OUR WEBSITE, WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, RELIABILITY OR TIMELINESS OF SUCH DESCRIPTIONS.

Quantity limits

WAG RC reserves the right to limit, at its sole discretion, the quantity of items purchased per person, per home or per order. These restrictions may be applied to orders placed by the same account, credit card and also to orders that use the same billing and/or shipping address. In addition, WAG RC reserves the right, in its sole discretion, to prohibit sales to other merchants or resellers.

Applicable law

These Terms of Use shall be governed by and construed in accordance with the laws of the Province of Quebec and the laws of Canada applicable therein, and any disputes shall be submitted to the courts of competent jurisdiction in the Province of Quebec, in the District of Montreal, except to the extent that the applicable laws of your jurisdiction require that the laws of such jurisdiction govern these Terms of Use. To the extent that any provision of these Terms of Use is unlawful, void, or for any reason unenforceable, that provision shall be deemed severable from these Terms of Use without affecting the validity of the remaining provisions.

General

These Terms of Sale, your order details and any other notices posted on the website constitute the entire agreement between you and WAG RC with respect to your purchase of products from our website. In the event that any provision of these Terms of Sale is found to be invalid or unenforceable, that provision will be struck and the remaining provisions will be enforced. Any delay or failure by WAG RC to act with respect to a breach of these Terms of Sale by you or others shall not constitute a waiver or limit WAG RC’s rights with respect to such breach or any subsequent breach. WAG RC shall not be liable for any delay or failure to perform its obligations under these Terms of Sale where such delay or failure results from circumstances beyond its control. These Terms of Sale may not be transferred without the written consent of WAG RC. These Terms of Sale shall be binding upon and inure to the benefit of (i) you, your heirs, executors, administrators or other legal representatives; and (ii) WAG RC and its successors and assigns. Notwithstanding any other provision contained in these Terms of Sale, any provision contained in these Terms of Sale that imposes or creates continuing rights or obligations on you or WAG RC shall survive the expiration and termination of these Terms of Sale.

Changes

The Terms of Sale applicable to your order are the Terms of Sale in effect on the date your order is placed, as proposed at the time your order is validated. WAG RC may modify these Terms of Sale from time to time in accordance with applicable law. Any modification will be applicable to any order placed after the effective date of such modification. Therefore, each time you place an order with WAG RC you confirm that you have accessed, read and accepted these Terms of Sale applicable to and governing that order.

Notices may be sent to you by e-mail or regular mail, or in the event of changes to these Terms of Sale, notices or links pursuant to such changes to these Terms of Sale may be posted directly on our website.
